Basic Terms / Privacy
On Top Marketing, LLC (OTM) reserves the right to refuse honoring a quotation if it feels that the quotation failed to cover all expenses and reasonable profits. Periodically, clients may receive information about news and special offers via mail or Email. Client may elect to cease these communications by notifying OTM by mail, or Email. OTM does not share any information about our clients to outside third parties (with the exception of third parties required to complete an order, and then only the information required to fulfill service).
Materials
All materials will be handled with care, but OTM assumes no responsibility for loss or damage of any materials provided by the client. OTM cannot guarantee that files submitted electronically will not be altered by the submission process. Clients must proof all projects for approval. Client should submit originals and retain copies of all materials submitted. Materials are returned upon completion of work.
Color Reproduction and Quality
OTM will try its best to produce a high quality and accurate reproduction of pictures and logos, but may be unable to achieve an exact match. All photography is subject to view on various computer monitors that OTM does not calibrate and has no control over. All print services are "gang-run" and are not a one-to-one match. Some color shift may occur during print spooling, raster image processing, or printing. OTM may advise clients when the reproduction quality is questionable and the client is responsible to make the final decision for usage of said materials. Accordingly, if color reproduction is "critical" a hardcopy proof should be requested (at additional charge).
Alterations and Extras
Any manipulation of original artwork will carry an hourly graphic design charge, upon acceptance by the client, rounding up to the next ½ hour, with a minimum of one (1) hour [for example, if 0.78 hours is required, 1.0 hour will be billed, also, if 1.45 hours is required, 1.5 hours will be billed]. Extras that fall into graphic design time charges include logos, photo manipulation, illustration and photo retouching. Call us for this rate.
Digital Files
Projects submitted on disk or online are the responsibility of the submitter. We try to catch problems that may result in improper printing (i.e. font conversions, color and resolution issues), but proper set-up is ultimately the responsibility of the client. OTM will not be held responsible for the improper printing of files supplied on disk. Files with errors may incur additional word processing charges to make them printable.
Proofing
OTM will provide proofs via Email attachments (PDF files) within 24 hours of receiving input from client. A "reasonable" number of proofs (3-4) are included in the price. If client has extensive changes or corrections, additional word processing time may be charged at an hourly rate. Changes should be in writing, however verbal "changes" will be accepted. All text must be proofed by the client to ensure accuracy. No changes will be accepted after client's approval of proof (this means spelling errors undetected, wrong phone numbers, etc.). PDF files are valuable for showing the color in a print service but may vary in appearance from actual printing due to the client's computer monitor calibration and version of Adobe Reader, which is outside of OTM's control. All "approvals" must be in writing (Email) before printing will commence!
Timing
Clients are advised on the turnaround time for each job (usually the next business day). It is in OTM's best interest to keep this turnaround time, however, OTM is not responsible for any damages that may be caused by late deliveries. All delivery dates are approximate and can vary due to equipment failure, emergencies, or inability to obtain required materials. Rush orders are available for all print services at an additional surcharge!
Quantities
Due to various factors in printing, actual printed quantities can vary by up to 10% above or below the original order. There is no charge when an overrun is the case (greater than the original order), but OTM will adjust its price when under printing occurs (less than 90% of the order). OTM will not re-run any jobs when the shortage is less than 10%.
Cancellation of Orders
Charges for cancellation of orders will be based on the timing of the cancellation: 1) If order is cancelled the same business day it was submitted, a full refund will be allowed. 2) If order is cancelled the next business day after order was placed up to one business day before anticipated fulfillment, 50% of charges will be refunded for that work. 3) If order is cancelled on the day of fulfillment, no refund will be granted. Orders not completed within 30 days of order date (due to client's delay) MAY be cancelled by OTM at its election and no refund granted.
For example, if client places an order on Friday for a Monday photo shoot and then cancels on the Sunday before the photography no refund will be allowed. Likewise, if an order is placed on Monday for a photo shoot the following Thursday and the order is cancelled on that Monday, a full refund will be allowed. If that same order is cancelled on Wednesday, 50% of the order charges will be refunded. And finally, if the order is cancelled on Thursday (the day scheduled for the shoot) no refund will be allowed.
Shipping and Handling
Printing charges include delivery to the customer's broker office. OTM may determine (at it's sole discretion) that delivery to another address, at the client's request, will still be covered by the printing charges. Delivery to another location via courier, at the election of the agent, will incur an additional delivery charge determined by OTM (within metro Denver the charge is typically $20.00). All services that are mailed will incur postage/handling charges determined by OTM based on the weight of the finished product, timeliness of mailing and the destination location.
Payment
OTM requires payment for all services at the time of order placement! Credit card payment is required on all orders. At OTM's discretion, other payment arrangements may be made. Taxes will be assessed based on the point of delivery.
What is Included
OTM's printing prices include one (1) hour of dedicated time toward the creative design and production of your project. This allotted time includes type-setting, graphic layout, proofing via Email, delivery to your broker's office, and any other task needed to complete your project, including phone calls and retrieving Email. If client supplies project on disk, this one (1) hour will include troubleshooting your files and making basic changes if needed. Additional word processing charges will be assessed if the time needed to complete your project exceeds the initial one (1) hour. OTM will notify client if these additional charges will be incurred.
Waivers
OTM reserves the right to reduce/waive any charges in favor of the client (i.e. not charge for additional word processing or graphic design work, etc.) at it's sole discretion. Should OTM elect to do this, the client is obligated to pay all other charges assessed.
Claims
All claims regarding services rendered must be submitted in writing for evaluation within ten (10) days of order completion.
